Trust Mortgages

Trust mortgages or mortgages taken out on behalf or in the name of a Trust are a specialist area of mortgage finance. We appreciate that the structure and complexity of Trusts is generally misunderstood by the majority of lenders or brokers. Typically, clients we successfully assist tell us of the difficulty they have experienced in trying to arrange a competitive Trust mortgage. Often they express their frustration in finding an appropriate lender or are a little unsure how to start their search.

 Trust Mortgage Case Study 1

Capital Fortune were approached to assist three Trustees arrange a Trust re-mortgage on an existing buy to let and also for the purchase of a second buy to let property. The existing buy to let property had no mortgage and the sole reason for raising the finance on the property was to capital raise the deposit for the new purchase. Both mortgages were completed successfully at a rate of 4.3% fixed for 2 years.

Trust mortgage applications often require a greater degree of negotiation with national lenders, the underwriters, their panel surveyors and property valuers. Clients we successfully assist, also appreciate there is a limitation on the number of providers in this specialist market and understand the fact that many do not openly advertise their available products direct to customers.

They appreciate that many lenders offering mortgages on Trust property have a significant number of restrictions, not only on the types of Applicant who can apply, but also often have stringent requirements on both the structure and legality of the Trust itself. This can include how the Trust document is drafted and how the Trust fund will be administered.

The Trust is usually established or about to be established and the Trust, Trustees or Beneficiaries usually have sufficient income to support the mortgage. They usually have a healthy deposit for a purchase or significant equity to undertake a re-mortgage. They find it difficult to understand why the vast majority of lenders will not consider their individual circumstances.

They confirm the additional problems they come up against, when they want to rent out the property or want to use the Trust property as their own home.  Trust Mortgage Case Study 2

Capital Fortune were instructed to assist a client arrange a Trust mortgage on a property inherited by the Trust from the client’s mother with grandchildren as beneficiaries. The property already had an existing mortgage in the client’s mother’s name and a refinance into the name of the Trust was required to secure the grandchildren’s inheritance moving forward. The mortgage completed at a rate of 5.29% fixed rate for 5 years.
